FEDERAL LAW ON PROTECTING THE RIGHTS OF LEGAL PERSONS AND INDIVIDUAL ENTREPRENEURS DURING THE CONDUCT OF STATE OVERSIGHT (REVIEW) AND MUNICIPAL OVERSIGHT

Article 14. Procedure for Organising an Inspection

3. Stamped copies of the instruction or order of the head or deputy head of the state body conducting oversight (review) or municipal body conducting oversight shall be delivered under signature by the officials of the state oversight (revision) body or municipal oversight body carrying out the inspection, to the head, other official or other authorized representative of the legal person or to the individual entrepreneur, or his/her representative, at the same time as the officials present their official identification.

At the request of those subject to inspection, the officials of the state oversight (review) body or municipal oversight body must provide information regarding these bodies , as well as about the experts and expert organizations, for the purpose of verifying their authority. 

Article 10. The Organisation and Carrying Out of an Unscheduled Inspection

4. An unscheduled inspection shall be carried out in the form of a document inspection and/or on-site inspection, in the manner stipulated under Articles 11 and 12 of this Federal Law. 

16. Regarding the carrying out of an unscheduled on-site inspection, with the exception of an unscheduled on-site inspection, the grounds for which are specified in the present Article (Section 2, Part 2), the legal person or individual entrepreneur is to be notified of an inspection by the state oversight (review) body or municipal oversight body not less than 24 hours before its implementation by any means available.

Article 11. Document Inspection 

11. When carrying out a document inspection, the state body conducting oversight (review) or municipal oversight body may not demand that the legal person or individual entrepreneur provide information and documents not related to the subject matter of the document inspection, and also information and documents which could be obtained by this body from other state bodies conducting oversight (review) or bodies conducting municipal oversight. 

Article 15. Limitations on conducting an inspection

When conducting an inspection, officials of the state oversight (review) body or municipal oversight body may not: 

3/ demand the presentation of documents, information, product samples, samples resulting from surveys of the surrounding environment and surveys of the industrial environment if they are not the subject matter of the inspection or are not relevant to the inspection, and may not take originals of such documents.
