Prosecutor General: Prosecution on Sole Grounds of “Disobeying Police Officers” Unlawful

The Prosecutor General’s Office has given its perspective on certain laws of the Code of Administrative Offences (CoAO) and the procedure for their application. The supervisory body has in fact recognised that prosecution cannot occur on the basis of Article 19.3 of the CoAO (disobeying a lawful order from a police officer) alone. 

This clarification was in response to a query by Alexander Kobrinsky, a member of the St. Petersburg City Parliament. 

The People’s Deputy alerted the Prosecutor General to the fact that, according to Article 4.3, Section 1, Point 1 of the Russian Federation CoAO, the “continuation of wrongful conduct, despite the demand of authorized persons to terminate it” is an aggravating factor, but cannot in itself be an offence. [Read more]
